This privacy statement describes how AMS Advocaten B.V. (“AMS”) handles the privacy of individuals involved with its business (including clients, visitors to its websites, subscribers to its newsletter, participants in workshops or seminars, job applicants, and other contacts). This privacy statement describes how AMS processes personal data and how data subjects can exercise their rights under the General Data Protection Regulation (GDPR).
A. PROCESSING OF PERSONAL DATA
AMS processes personal data in the context of its legal services. AMS is the controller within the meaning of the GDPR and has the following contact details:

The processing of personal data by AMS is carried out in accordance with privacy regulations and in the manner described in this privacy statement.
A.1. Clients and data subjects
In the context of our legal services, we may process the following personal data of our clients or data subjects: name and address details, gender and title, contact details (such as email address and telephone number), business details (such as company name, extract from the commercial register and VAT number), passport photo/copy of passport and bank details.
In principle, we base the processing of your personal data on Article 6(b) of the GDPR: to perform the contract we have with you, such as providing advice, conducting proceedings, settling bankruptcies, or other legal work. In addition, we process personal data to comply with legal obligations (such as the identification requirement under the Lawyers Act or the Money Laundering and Terrorist Financing Prevention Act) or tax obligations. We may also process personal data to represent our legitimate interests, such as improving our services. If your personal data is processed on the basis of consent, you will be explicitly asked for your consent.
A.2. Website visitors
Any website visitor can leave contact details on the AMS website as part of our online services. We use this information to contact you and store it for as long as necessary to answer your question.
A.2.1. Cookies
AMS keeps usage data from its website(s) for statistical purposes. The personal data collected in this way is anonymous in principle. The website uses Google Analytics cookies to track user behaviour and general trends and to obtain reports. This helps to improve the functioning of the website. Google may provide this information to third parties if Google is legally required to do so or insofar as third parties process the information on Google’s behalf. Google is certified under the EU-U.S. Data Privacy Framework (2023). By using the AMS website, you consent to the processing of this information by Google in the manner and for the purposes set out above.
Cookies are also placed through the use of buttons and/or links, such as when using social media (see below). AMS has no influence on the placement and use of cookies by these third parties.
A.2.2. Use of social media plugins
Pages on our website can be shared via LinkedIn, X (formerly Twitter), and Facebook. AMS does not supervise and is not responsible for the processing of your personal data by and through such third parties. The use of these media is therefore at your own risk. Please read the privacy statements of these third parties first.
A.3. Newsletter subscribers and event participants
AMS sends out a newsletter periodically. For this purpose, we collect personal data such as your (company) name and email address. You will only receive the newsletter if you have given your consent and/or if you are an existing client and we wish to inform you about legal services and developments that are relevant to you.
For the newsletter, we use the services of Mailchimp, which stores data in the United States. Mailchimp is certified under the EU-U.S. Data Privacy Framework (2023). If you no longer wish to receive the newsletter, you can unsubscribe at any time via the link in the newsletter.
For registrations for workshops, seminars, or similar events, AMS processes personal data such as name and address details, telephone number, email address, company name, and job title, and, where applicable, data requested for the registration. We process this data on the basis of your consent.
A.4. Job applicants
AMS regularly publishes job vacancies on its website or social media. In the context of job applications, we process name and address details, contact details, date of birth, gender, application details (resume, cover letter, transcripts, internship reports), and any other data provided in the context of the application. We process this data on the basis of our legitimate interest in finding suitable personnel. The data is used exclusively for recruitment and selection activities and not for any other purposes.
A.5. Other relationships
AMS processes personal data from suppliers or other service providers that is necessary for deliveries or the purchase of services, such as name and address details, telephone number, email address, and bank account number. We process this data in order to execute the agreement or to comply with legal obligations.
B. YOUR PERSONAL DATA AND THIRD PARTIES
AMS only shares personal data with third parties to the extent necessary for the provision of services, with due observance of the aforementioned purposes. This includes IT suppliers, bailiffs, couriers, or judicial authorities. In addition, AMS may provide personal data to supervisory authorities or other public authorities, insofar as there is a legal obligation to do so.
A processing agreement is concluded with processors who process personal data on behalf of AMS. Third parties acting as independent controllers (such as accountants or notaries) are themselves responsible for compliance with the GDPR.
C. SECURITY
AMS attaches great importance to the security of personal data and takes appropriate technical and organizational measures to ensure a level of security appropriate to the risk. If AMS uses the services of third parties, such as IT suppliers, agreements on adequate security measures are laid down in processing agreements.
If AMS transfers data outside the European Economic Area (EEA), this will only be done to countries for which an adequacy decision applies, to recipients certified under the EU-U.S. Data Privacy Framework (2023), or on the basis of model clauses adopted by the European Commission.
D. RETENTION PERIOD
AMS does not retain personal data longer than necessary for the purposes of processing or as required by law and regulations. Client files are generally retained for five years.
E. PRIVACY RIGHTS
You can submit a request for access, correction, restriction, deletion, data portability, or withdrawal of consent via info@amsadvocaten.nl stating "Exercise of privacy rights," or by mail to AMS Advocaten B.V., PO Box 69111, 1060 CD Amsterdam. We may ask for identification for verification purposes. We aim to respond within one month.
In certain cases, AMS may not be able to comply with a request, or only partially comply, for example due to the legal obligation to retain data or the duty of confidentiality of lawyers. If you believe that our processing violates privacy legislation, you can submit a complaint to the Dutch Data Protection Authority.
